Climate lawsuits: Climate neutrality in the Basic Law does not make them any more promising.

If the CDU/CSU, SPD and Greens write climate neutrality into the Basic Law by 2045 as planned, this does not appear to improve the immediate chances of climate lawsuits. „There is no reason to fear that infrastructure projects will be increasingly prevented by lawsuits,“ said Remo Klinger, a specialist lawyer for climate law who often represents Deutsche Umwelthilfe (DUH). He sees inserting the term into the Basic Law as „primarily descriptive and declaratory, which does not change the legal situation of project approval law,“ Klinger told Table.Briefings.
