To limit the power of internet platforms, the EU is working on the Digital Markets Act (DMA). The Commission’s draft DMA looks promising and shows credible ambitions to crack down on digital gatekeepers like Google or Facebook and fight their monopoly power in Europe.
However, it is crucial for the DMA’s conduct measures to work that the obligations on platforms come into force quickly and without delay. But not all of the rules set out for gatekeepers are immediately applicable. Some allow for a so-called regulatory dialogue with gatekeepers before the rules are enforced. BigTech lobbyists want to use this opportunity to undermine enforcement of the rules: Regulatory dialogues provide an opportunity to challenge or at least delay obligations on gatekeepers.
